O.Reg. 316/07: Designation and Classification of Provincial Parks under the Provincial Parks and Conservation Reserves Act, 2006 (PPCRA) - Amendments to Bronte Creek Provincial Park
Regulation Number(s):
O. Reg 316/07
Instrument Type:
Regulation - LGIC
Bill or Act:
Provincial Parks and Conservation Reserves Act, 2006
Summary of Decision:
The Ministry of the Environment, Conservation and Parks (MECP) approved an administrative amendment to O. Reg. 316/07 (Designation and Classification of Provincial Parks) under the Provincial Parks and Conservation Reserves Act, 2006 (PPCRA) to remove two parcels totaling 0.115-hectares (ha) (0.28 acres) from Bronte Creek Provincial Park.
Analysis of Regulatory Impact:
This amendment was considered a non-substantive administrative correction to a boundary error and was therefore not subject to posting on the Regulatory Registry. Approval of this amendment now enables the Region of Halton to occupy the lands without seeking annual authorization from MECP, resulting in a minor benefit to the Region of Halton by eliminating the need for additional administrative work.

Summary of Proposal:
A minor amendment was made to boundary of Bronte Creek Provincial Park on the western edge of the town of Oakville, to remove two small parcels of land totalling 0.115-ha (0.28 acres) adjacent to Dundas Street (Regional Road 5).
In 2021, the subject lands were transferred to the Region of Halton to support a broader transportation project, which is currently underway adjacent to the provincial park and will improve access to public transportation for residents, increase accessibility to the park, and reduce overall traffic around the area.
The Region of Halton had previously completed consultation through a Municipal Class Environmental Assessment in 2015, performed additional outreach and completed various surveys with local residents and stakeholders, to discuss the proposed road widening and associated encroachment into Bronte Creek Provincial Park.
As a result of the transfer, the Region of Halton assumed ownership and management responsibility of the two parcels, however, they were required to seek annual authorization to carry out work on the lands since the parcels were still regulated as part of the park despite not being managed by MECP.
The approved amendment to the boundary of Bronte Creek Provincial Park simply deregulated and excluded these parcels from the park, aligning with the fact the title for these lands is already under the jurisdiction of the Region of Halton, not resulting in any operational changes.
