The Ministry of the Solicitor General made a regulation amendment to increase provincial fee paid to hospitals for the use of facilities to perform post mortem examinations for death investigations. In addition, the ministry also made some non-substantive housekeeping amendments to the regulation with no material impact in regulation for regulated entities.

There are no compliance costs for stakeholders related to this proposed regulatory amendment to increase the fees paid by the province for use of hospital facilities for post-mortem examinations.
This regulatory amendment will provide increased stability and ensure that that the hospitals can continue to perform post-mortem examinations for death investigations.

Summary of Proposal:
Forensic pathology units and community hospitals across Ontario provide post-mortem services on behalf of the Office of the Chief Coroner and Ontario Forensic Pathology Service as part of death investigations.
As set out in minister's regulation O. Reg 19/15 Schedule 3, the province pays a fee to a "hospital or other place" for "the use of facilities" for a post-mortem examination. This facility fee is paid to forensic pathology units and community hospitals for overhead costs (e.g., cleaning, consumables, security).
The Ministry of the Solicitor General intends to make an amendment to O. Reg 19/15 Schedule 3 to increase the provincial fee paid to hospitals for the use of facilities from $400 to $700 per post-mortem examination. The fee covers hospital overheads including, cleaning, consumables, security, etc. In addition, the ministry is also taking the opportunity to make some non-substantive housekeeping amendments to the regulation that will have no material impact in regulation for regulated entities. Schedule 3 of O. Reg 19/15 would be amended as provided in the Attachment A.
The amended regulation would be effective upon filing.
