Summary of Decision:
A regulatory amendment has been made that adds Homelessness and Addictions Recovery Treatment (HART) Hubs to the list of entities exempted from the residential licensing requirements under the Fixing Long-Term Care Act, 2021. This regulatory amendment was made as HART Hubs are not considered long-term care homes. This regulation came into force on March 21st.
Analysis of Regulatory Impact:
The proposed regulatory amendment under the FLTCA would only impact Homelessness and Addiction Recovery Treatment (HART) Hub services that include residential stays and overnight nursing care at the same place.
If a regulation is determined to be advisable by the Minister, there would be no financial impacts to HART Hubs operating residential premises for persons requiring nursing care or in which nursing care is provided to two or more unrelated persons.

Summary of Proposal:
On August 20, 2024, the Ministry of Health announced its plan to invest $378 million in a Demonstration Project for 19 Homelessness and Addiction Recovery Treatment (HART) Hubs across the Province to enable enhanced access to a suite of integrated, locally tailored health and human services supporting the treatment and recovery of individuals with complex service needs (e.g., mental health and addictions, primary care, employment and social services, etc.). HART Hubs will also support stability and improved long-term outcomes for vulnerable people in Ontario by providing the opportunity to leverage proximate partners and offer a direct pathway to supportive housing. In-scope services eligible for funding at each Hub may include, for example, primary care, case management, shelter beds, transitional beds, bed-based services (e.g. withdrawal and treatment beds), naloxone access and food security, in addition to social services and employment services.
This proposal seeks to amend s.316 of O. Reg. 246/22 under the Fixing Long-term Care Act, 2021 (FLTCA) to add HART Hubs to the list of premises that are excluded from the licensing requirement in section 98 of the Act to operate a residential premises for persons requiring nursing care or in which nursing care is provided to two or more unrelated persons.
These proposed changes build on key government commitments such as Roadmap to Wellness and Your Health: A Plan for Connected and Convenient Care to further enable greater accountability and support a mental health and addictions system that focuses on treatment and recovery and is more responsive to the needs of Ontarians.
