Proposed regulatory amendment to O. Reg. 208/09: Tobacco - Marketing under the Farm Products Marketing Act.
Regulation Number(s):
O. Reg. 208/09
Instrument Type:
Regulation - Other
Bill or Act:
Farm Products Marketing Act
Summary of Proposal:
The requested amendment is to change the annual deadline for growers to provide acreage information to the Ontario Flue-Cured Tobacco Growers' Marketing Board (OFCTGMB) from July 1 to March 20 in each year.
In April 2021, the Ontario Farm Products Marketing Commission reinstated the OFCTGMB's ability to set and collect licence fees. To ensure alignment with the registration scheme outlined in the Tobacco Tax Act (TTA) and to provide the OFCTGMB with ample time to draft regulations and inform producers about their regulatory obligations to pay licence fees for the 2021 production season, the Commission set the July 1 acreage declaration date in O. Reg. 208/09 Tobacco - Marketing.
The April 2021 amendments contained a transition provision related to licensing producers during the 2021 crop year. This section is now obsolete and the Commission is proposing to remove it.
Analysis of Regulatory Impact:
The proposed regulatory amendment is not anticipated to result in any compliance costs or savings.
