Summary of Proposal:
In June 2021, the Legislature passed the Accommodation Sector Registration of Guests Act, 2021 (ASRGA), as part of the Combatting Human Trafficking Act, 2021. Once in force the ASRGA would replace the Hotel Registration of Guests Act. The ASRGA was created to assist in combatting human trafficking in the accommodation sector, which is commonly used by traffickers.
The proposed regulation, if made, would provide police services with operational clarity in relation to urgent demands for records in the accommodation sector and the annual reports required to detail the number of urgent demands processed in a given year. Additionally, the proposed regulation would prescribe those businesses in a class that must maintain a register and comply with register requirements. The proposed regulation would prescribe other information that must be recorded in a register and the period that the recorded information must be maintained in a register.

Analysis of Regulatory Impact:
The proposed regulation would carry forward some requirements from the Hotel Registration of Guests Act and would introduce new information collection and maintenance requirements, some of which would codify existing business practices. The Accommodation Sector Registration of Guests Act, 2021 coming into force would also remove the requirement to post maximum room rates.
The Ministry of the Solicitor General and the Ministry of Tourism, Culture and Gaming may be consulting with stakeholders to identify whether there are any potential costs associated with the given regulation coming into force.
