Summary of Decision:
On November 12, 2024, O. Reg. 455/24 and O. Reg. 456/24 both made under QCIPA, 2016 came into force. These two regulations had the effect of revoking two prior regulations (specifically O. Reg. 297/04 and O. Reg. 330/04) that were originally made under the now-repealed predecessor QCIPA, 2004 statute.
Analysis of Regulatory Impact:
Revoking these two outdated and duplicative regulations that were originally made under the predecessor statute, QCIPA, 2004, will help clarify the application of the current regulatory framework under the QCIPA, 2016 statute for stakeholders and reduce potential confusion.

There are no costs or impacts associated with the revocation of these two outdated regulations.

Summary of Proposal:
QCIPA, 2004 was originally enacted in 2004. Following a review of that statutory scheme, that Act was subsequently repealed and replaced with a successor statute, QCIPA, 2016.

Two regulations originally made under the now-repealed QCIPA, 2004 were never revoked at the time that the successor QCIPA, 2016 statute came into force and were consequently continued under that successor statute:
• O.Reg. 297/04: DEFINITION OF 'QUALITY OF CARE COMMITTEE (Minister's regulation); and;
• O.Reg. 330/04: GENERAL (Lieutenant Governor in Council regulation).

The subject matter of these two outdated regulations has since been largely duplicated in the two new/current regulations (O.Reg. 482/16 and O.Reg. 483/16) that were subsequently made under QCIPA, 2016.

As a result, it was proposed that the two outdated regulations originally made under the predecessor QCIPA, 2004 statute should be revoked, as they were both outdated and duplicative.
