Consultation on Proposed Regulations Regarding Condo Owners' Meetings and Expansion of the Condominium Authority Tribunal's Jurisdiction to Include Owners' Meetings

Summary of Proposal:
The Ministry is exploring bringing into force some amendments to the Condo Act that were enacted in 2015 under the Protecting Condominium Owners Act, 2015, Schedule 1 (PCOA), but which are not in force. These PCOA provisions relate to owners' meetings and can be viewed in the attached document explaining the proposed changes.

The Ministry is also proposing amendments to regulations under the Condo Act that would support the proclamation of these PCOA provisions. These regulatory amendments are also explained in the attached document.

In addition, the Ministry is proposing regulatory amendments to expand the jurisdiction of the Condominium Authority Tribunal (CAT) so that it may resolve disputes relating to condo owners' meetings. These proposed regulatory amendments are summarized in the attached document as well.

Analysis of Regulatory Impact:
The Ministry is conducting a Regulatory Impact Analysis.

To further inform this analysis, the Ministry is seeking feedback on the potential costs and impacts associated with the proposal, including any potential operating and administrative costs for condo corporations and businesses supporting condo corporations. A key objective of the proposal is to strengthen governance and accountability within condo communities by clarifying processes related to requisitioning, calling and holding owners' meetings, and enabling a cost-effective method of resolving disputes related to owners' meetings through the CAT.

The Ministry is particularly interested in insights regarding the anticipated financial implications for businesses, potential benefits for condo communities, and any challenges that may arise during implementation. Where possible, please provide examples or evidence to support your views.
