Summary of Decision:
Ontario Regulation 439/10 (Hogs – Marketing) was approved by the Ontario Farm Products Marketing Commission on November 26, 2010; was filed with the Registrar of Regulations on November 30, 2010; and, is now in force. R.R.O. Regulation 419 (Hogs –Plan) is revoked by O.Reg. 439/10. The provisions within Regulation 439/10 complement Regulation 403/10 (Hogs – Plan) made by the Lieutenant Governor in Council and filed with the Registrar of Regulations on October 25, 2010.

Summary of Proposal:
Under provincial regulations, the Ontario Pork Producers’ Marketing Board (“Ontario Pork”) has authorities regarding the marketing of hogs in Ontario. Ontario Regulation 439/10 (Hogs – Marketing) allows for an open market approach for the province’s hog sector; key provisions of the regulation include:

• Providing authorities for Ontario Pork to:
- collect licence fees
- offer hog marketing services
- produce, collect and disseminate price information in the aggregate
- collect licence fees on all classes of hogs
- require those who are engaged in buying/selling hogs to submit transaction records to Ontario Pork
• The establishment of at least two funds by Ontario Pork;
- one for the Marketing Division; and,
- at least one for the Universal Services Division
• The appointment of all members to an industry advisory committee by the Commission with the following representation:
- three producers
- three processors
- one shipper
- one individual who provides marketing services to buyers and sellers of hogs.
