The new regulation amends ESA Regulation 288/01 by making that regulation's exemptions from severance pay and notice of termination inapplicable where the employment contract has been frustrated due to illness or injury. The amendment reflects the May 2005 Ontario Court of Appeal decision in Ontario Nurses' Association v. Mount Sinai Hospital.
