Summary of Decision:
Ontario Regulation 318/08 (Transitional - Small Drinking Water Systems) and Ontario Regulation 319/08 (Small Drinking Water Systems) both made under the Health Protection and Promotion Act were filed on September 16, 2008, as originally proposed.

As outlined in the proposal notice for these regulations, several Ministry of the Environment regulations were required in order to effect the transfer of legislative and regulatory authority of small drinking water systems from the Ministry of the Environment to the Ministry of Health and Long Term Care and Public Health Units.

These regulations include the revocation of O. Reg. 252/05 made under the Safe Drinking Water Act, 2002 (SDWA), as well as consequential amendments to eight regulations made under the SDWA (O. Reg. 169/03, O. Reg. 170/03, O. Reg. 171/03, O. Reg. 172/03, O. Reg. 188/07, O. Reg. 242/05, O. Reg. 128/04, O. Reg. 248/03.)

In addition, the transfer of regulatory authority for these small drinking water systems required a consequential amendment to Ontario Regulation. 31/05 (Meat ) made under the Food Safety and Quality Act, 2001 in order to remove references to Ontario Regulation. 252/05 and replace them with references to the proposed small drinking water systems regulations made under the HPPA.

Ontario Regulation. 330/08 made under the Food Safety and Quality Act, 2001 was filed on September 17, 2008.

All of the Safe Drinking Water Act regulations will come into force on December 1, 2008 along with the MOHLTC regulations and the OMAFRA consequential amendment to Ontario Regulation. 31/05.

Summary of Proposal:
The regulations being proposed include the revocation of O. Reg. 252/05 (the interim regulation that currently applies to the systems being transferred), as well as consequential amendments to eight regulations under the Safe Drinking Water Act (SDWA), (O. Reg. 169/03, O. Reg. 170/03, O. Reg. 171/03, O. Reg. 172/03, O. Reg. 188/07, O. Reg. 242/05, O. Reg. 128/04, O. Reg. 248/03) to ensure a seamless transfer of the regulatory authority for small drinking water systems from the SDWA to the Health Protection and Promotion Act (HPPA).

In addition, the transfer of regulatory authority for these small drinking water systems requires an amendment to O. Reg. 31/05 (Meat ) made under the Food Safety and Quality Act, 2001. This proposed amendment will continue the existing requirement for a meat plant operator to notify the regional veterinarian and the on-site meat inspector (if any) in any situation where they receive notification from a system currently regulated under O. Reg. 252/05 to use an alternative source of water or boil the water. The change would remove the reference to O. Reg. 252/05 and replace it with a reference to drinking water systems regulated under the Health Protection and Promotion Act.
