Ontario Tire Stewardship (OTS) has requested an amendment to Ontario Regulation 84/03 (Used Tires) made under the Waste Diversion Act, 2002 to incorporate by reference a revised 'OTS Tire Classification' document before the end of April 2013. The document includes a listing of tire classes that are collected through the Used Tires Program. Without an amendment, a revised OTS Tire Classification document would not take effect until January 1, 2014.
In order for the revised OTS Tire Classification document to be incorporated by reference into the regulation, the following amendments to O. Reg. 84/03 must be made:
Subsection 1(2): Change the reference to the OTS Tire Classification in respect of 2013 to "the document of that title that is made available on the website of Ontario Tire Stewardship on or before April 19, 2013"; and
Subsection 8 (5)(a): Amend the date OTS is required to provide written notice to each steward regarding the cost attributable to each tire class, the number of tires assigned to each tire class and the cost attributable to a tire in each tire class in respect of the base fee period beginning April 1, 2013 and ending on April 30, 2014 as "on or before April 19, 2013".
