A proposal for legislative amendments to the Mining Act, continuing the implementation of Mining Act Modernization process
Regulation Number(s):
N/A
Instrument Type:
Act
Bill or Act:
The Mining Act R.S.O. 1990, Chapter M. 14
Summary of Proposal:
The Ministry of Northern Development and Mines (MNDM) has consulted extensively on the introduction of a fully electronic claim staking across the province - starting with the Ontario Mineral Development Strategy in 2006, continuing with respect to Bill 173 (the Mining Amendment Act, 2009) and in a number of subsequent postings on the Environmental Registry. The foundation for online staking was enacted as part of Bill 173; however, as the necessary Information Technology (IT) system and processes were not assessed at that time, some further technical changes are necessary to properly implement online staking, supported by a fully integrated, digital online mining land administration system. This proposal is to make minimal technical changes to the Mining Act to implement online staking, a modernized and mining lands administration; and to provide for a transition from the current to the new system necessary transition rules.
Further details of the proposal for proper implementation of online staking and mining lands administration are provided in the attached document entitled, The next step: Continuing the implementation of Mining Act Modernization in Ontario. If the legislative changes contemplated in this proposal are enacted, regulations would be developed and proposals for regulations would be posted for public review and comment.
