Summary of Proposal:
This amending regulation would, if approved by Cabinet, exempt provincially regulated employee truck and bus drivers (employee commercial motor vehicle drivers) from the Employment Standards Act, 2000 hours of work provisions (ESA/HOW). This exemption would only apply to employee commercial motor vehicle drivers that are subject to the Highway Traffic Act Hours of Service regulation (HTA/HOS) (O.Reg. 555/06).
Currently, employee commercial motor vehicle drivers are covered by both the HTA/HOS and the ESA/HOW. The application of these sets of rules has led to regulatory burden for employers.
