Summary of Decision:
On October 21, 2015 the Ontario Farm Products Marketing Commission (Commission) amended R.R.O. 1990, Regulation 400: By-Laws for Local Boards, made under the Farm Products Marketing Act (FPMA), to revoke the specific quorum requirement for board meetings of the Ontario Greenhouse Vegetable Growers (OGVG). The OGVG's quorum requirement is now the same as all other local boards established under the FPMA.

The amendments to Regulation 400 became effective on November 13, 2015.

Summary of Proposal:
There are two districts established in Regulation 418 (Greenhouse Vegetables - Plan) that require five producers to be elected or appointed from each district to create a total of ten voting members.

In addition, the Chair of the OGVG is appointed annually by the Ontario Farm Products Marketing Commission. This position does not have a vote.

Regulation 400 outlines a number of general requirements for all marketing boards established under the FPMA. The Commission is proposing to amend section 6 (b), which sets the quorum for board meetings for the OGVG, to reduce the quorum requirement from from seven voting members to six.
