O. Reg. 301/15 amends R.R.O. 1990, Regulation 737 under the NSBA.

This amendment adds the Power of Garbage Collection to the powers of the Local Services Board of Aweres. The Power of Garbage Collection allows the Local Services Board to establish and maintain a system for the collection and removal of garbage or contract for the collection, removal and disposal of garbage.

The Local Services Board underwent all of the necessary steps required by the NSBA to acquire the Power of Garbage Collection. These steps included consultations with inhabitants as well as a vote put forward to the inhabitants. Inhabitants voted unanimously in favour of the request.

The Ministry of Northern Development and Mines completed the due diligence and the regulation was made by the Minister of Northern Development and Mines. The Regulation was filed on September 29, 2015.

Summary of Proposal:
During the months of May and June 2014, the Local Services Board of Aweres undertook the complete steps in accordance with the Northern Services Boards Act to request to vary its powers to add the Power of Garbage Collection. Steps undertaken include a public information session and vote with the inhabitants at a meeting called for that purpose.

Approximately 62% of the inhabitants present and voting at the meeting voted in favour of the proposal. The Ministry is now undertaking an assessment to verify that all of the necessary steps were completed, following which a decision will be made as to whether to grant the power of garbage collection to the LSB. The Power of Garbage Collection would allow the Local Services Board to establish and maintain a system for the collection and removal of garbage or contract for the collection, removal and disposal of garbage.

The LSB of Aweres is part of the Sault North Planning Area which is an unincorporated area north of the City of Sault Ste. Marie encompassing 31 townships (approximately 2600 km2). This area has a population of approximately 10,000 permanent and seasonal residents and has only two active waste disposal sites. The majority of the residents are serviced by the Havilland Waste Disposal Site.

The Power of Garbage Collection would allow the LSB of Aweres to collect a levy or fee from the inhabitants that would be used to maintain a sustainable recycling service. The recycling program in the Sault North area has been delivered by the Sault North Waste Management Council since 2006. Residents currently contract garbage collection on a user-pay system directly with a service provider.
