Summary of Proposal:
The application of the EBR is determined by two regulations
Ontario Regulation 73/94 (General)
Determines which ministries and Acts are subject to the EBR
Ontario Regulation 681/94 (Instrument Classification)
Determines which instruments (such as approvals, permits or orders) are posted on the Environmental Registry
The ministry is proposing to amend Ontario Regulation 73/94 as follows;
Add the Treasury Board Secretariat to sections 1 and 2 of the regulation
This will require that the Treasury Board Secretariat develop, consult on and follow a Statement of Environmental Values
The EBR requires that each prescribed ministry develop, consult on and publish a Statement of Environmental Values (SEV) which they must consider when making decisions that might significantly affect the environment.
The SEV acts as a guide for ministries to ensure the purposes of the EBR are met in decisions involving the environment. and;
require that the Treasury Board Secretariat use the Environmental Registry to consult on decisions related to environmentally significant policies and Acts
Add the Places to Grow Act to section 3
This will require that the Ministry of Municipal Affairs and Housing use the Environmental Registry to consult on decisions to make, amend or revoke regulations that could impact the environment under the Places to Grow Act
Add the Invasive Species Act to sections 3 and 9
This will require that the Ministry of Natural Resources and Forestry use the Environmental Registry to consult on proposals to make, amend or revoke regulations under the Invasive Species Act that could impact the environment.
This will make the Invasive Species Act subject to applications for investigation
The Ministry of the Environment and Climate Change has reviewed Ontario Regulation 681/94 and has no amendments at this time.
