Amendment to O. Reg. 535/05 - Ethanol in Gasoline

Summary of Decision:
A decision was made to proceed with the amendments to O. Reg. 535/05 consistent with the proposals as described in the regulatory proposal notice posted on February 1, 2016, with minor modifications as a result of comments received. The amended regulation, which was filed on December 19, 2016, will come into force on January 1, 2017. Changes from the original regulation are summarized as follows:

- Including ethanol derived from municipal solid waste (MSW) under the definition of "cellulosic ethanol" in subsection 1(1) and requiring that, for the determination of compliance Section 4 (1), the bio-based component of post-diverted MSW be demonstrated according to a prescribed frequency and the test method ASTM D6866-16
- Removal of outdated, time-limited exemption for, and references to, Northern Ontario (definition of "Northern Ontario" in Subsection 1(1) and definition "F" in subsection 4(1), Subsections 3(3) and Clause 5(2)(c)), and outdated exemptions for fuel produced for a limited time under a fuel quality variance in Subsections 2(6) and 2(7))
- Updating Subsection 2(1) to reference the latest version of the applicable fuel standard for ethanol-blended gasoline: CAN/CGSB-3.511-2016
- Updating Subsection 2(1) to replace ASTM D5798 standard with CAN/CGSB-3.512-2013 standard
- Updates to Subsection 2(2) to reference the latest versions of applicable fuel standards for ethanol: CAN/CGSB-3.516-2011 and ASTM D4806-16a

The amendments to the Ethanol in Gasoline regulation do not change Ontario's commitment under the Climate Change Action Plan to develop a modern renewable fuel standard for gasoline.
