Amendment to Ontario Regulation 73/94 under the Environmental Bill of Rights (EBR) to prescribe the Ministry of Education for Applications for Review

Summary of Decision:
Ontario Regulation 73/94 was amended and filed on September 5, 2017 and is now in effect.
This amendment makes the Ministry of Education subject to the applications for review provisions under the Environmental Bill of Rights, 1993 (EBR).
Residents of Ontario can now make an application to the Environmental Commissioner of Ontario to request that the Ministry of Education review;
An existing policy, act, regulation or instrument (approval/permit), where the applicants believe that the policy, act, regulation or instrument should be amended, repealed or revoked in order to protect the environment
The need for a new policy, act or regulation, where the applicants believe that the new policy, act or regulation should be made or passed in order to protect the environment.

The Environmental Bill of Rights, 1993 (EBR) provides a number of opportunities for the public to influence and be involved in the Ontario Government's environmental decision-making process.
The application for review process under part IV of the EBR allows any two (2) residents of Ontario to apply to the Environmental Commissioner of Ontario (ECO) for a review of an issue by the appropriate minister.
Specifically, a request can be made to review:
• An existing policy, act, regulation or instrument (approval/permit), where the applicants believe that the policy, act, regulation or instrument should be amended, repealed or revoked in order to protect the environment
• The need for a new policy, act or regulation, where the applicants believe that the new policy, act or regulation should be made or passed in order to protect the environment
The ministries, acts, regulations, and instruments that are subject to the EBR's application for review provisions are set out in O. Reg. 73/94, made under the EBR.
The Ministry of the Environment and Climate Change is proposing to amend section 5 of O. Reg. 73/94 by adding the Ministry of Education to the list of ministries that are subject to the application for review provision under Part IV of the EBR.
