Summary of Proposal:
The Protecting Condominium Owners Act, 2015 (PCOA) received Royal Assent on December 3, 2015, marking the first overhaul of the province's condominium law in over 16 years. PCOA amends the Condominium Act, 1998 and enacts the Condominium Management Services Act, 2015. Implementation of the Protecting Condominium Owners Act will take place in phases.
The Ministry of Government and Consumer Services is proposing regulations to support amendments to the Condominium Act. These regulations would support implementation of the requirement for condominium corporations to file annual and other specified returns containing information about the corporation with the Registrar appointed by the condominium authority. Certain information in the returns would need to be updated throughout the year if the information changes.
The proposal would also address requirements for the Registrar to maintain a database of information about condominium corporations in the province, including information from the returns that corporations file on a periodic basis. Information collected by the Registrar and maintained in the database would be made available to the public.
A second regulation proposal would amend the regulation designating the Condominium Authority of Ontario as the condominium authority to add Part II.1 and section 134.1 of the Condominium Act to the provisions administered by the Condominium Authority of Ontario.
The proposal incorporates input that was received during an open and collaborative public engagement process that the government undertook from 2012-2014 as a part of the Condominium Act review, as well as from additional input received since then.
The ministry is proposing to have this regulatory proposal and related Condominium Act amendments come into force in early 2018. A more detailed description of the proposal is included in the link under "Further Information".
The ministry welcomes feedback and encourages anyone interested to provide comments on the proposal.
