Proposed amendments to regulations under the Highway Traffic Act related to Oversize Overweight Permit fees

Summary of Proposal:
The Ministry of Transportation is proposing changes to the Oversize/Overweight Permit structure. The proposed changes will amend Ontario Regulation 381/98 (Special Permits) under the Highway Traffic Act. The Regulation currently has one category for annual permits and one for project permits. Under the proposal, MTO is planning to introduce an additional category of enhanced annual permits and a category of enhanced project permits. Different fees are proposed for enhanced permits than for basic permits.

Basic annual permits will be valid for use on vehicle configurations with width of 3.85m, a height of up to 4.26m, a length of up to 25m and a weight less than 63,500kg. Vehicles exceeding those limits would require enhanced permits. The current fee for an annual permit ($440) will remain the fee for basic annual permits. The proposed enhanced annual permit fee is $730.00.

Basic project permits will be valid for use on vehicle configurations where the width does not exceed 4.3 m, the length does not exceed 36.75m, and the weight does not exceed 70,000 kg. Vehicles exceeding those limits would require enhanced permits. The current fee for a project permit ($286) would remain the fee for basic project permits. The proposed enhanced project permit fee will be calculated based on the number of trips under the project.
The Ministry of Transportation has committed to enhancing its Oversize/Overweight Permit program by providing a streamlined and more efficient permit process; the proposed new permit structure will provide products that balance the needs of the stakeholders and the ministry's road safety obligations.
