Analysis of Regulatory Impact:
As part of its obligations under the Reducing Regulatory Cost for Business Act, 2017 (RRCBA), the ministry has conducted the Regulatory Impact Analysis (RIA) to identify incremental direct compliance costs, including administrative costs, to for-profit child and youth service providers (businesses). Under the RRCBA, the ministry is required to report on total incremental administrative costs to businesses. The majority of child and youth service providers subject to the CYFSA are not-for-profit service providers and are not included in this analysis.

The proposed regulatory provisions identified in this posting fall under the General Consolidated LGIC regulation (O. Reg. 155/18). Total annual incremental administrative costs to businesses associated with the General Consolidated LGIC regulation as a whole are estimated to be $480,000.

Summary of Proposal:
Warrants under Part V of the CYFSA:

Provisions in Regulation 70 under the CFSA that relate to obtaining a warrant to enter premises or obtain a record are proposed to be remade in a regulation under the CYFSA. Minor changes are proposed to these regulatory provisions to replace references to the CFSA with references to the corresponding provisions in the CYFSA.

Court Ordered Assessments:

The majority of provisions relating to court ordered assessments in O. Reg 25/07 under the CFSA are proposed to be remade in a regulation under the CYFSA with no substantive changes (e.g. replacing references to the CFSA with references to the corresponding provisions in the CYFSA).

One provision relating to criteria for ordering an assessment (section 2 of O. Reg 25/07 under the CFSA) is not in regulation as that provision was imported into the CYFSA as subsection 95(2).

Alternative Dispute Resolution:

All provisions relating to methods and procedures for alternative dispute resolution (ADR) presently contained in O. Reg 496/06 under the CFSA are to be remade as a regulation under the CYFSA with no substantive changes (e.g. updating references to provisions in the CFSA with references to the corresponding provisions in the CYFSA) in order to maintain the current framework for child protection ADR.
