Proposal to upload new subway projects to the Province if Bill 107, Getting Ontario Moving Act (Transportation Statute Law Amendment), 2019, is passed into law by the Ontario Legislature

Summary of Decision:
A new regulation was made to prescribe Toronto's proposed Relief Line, the Yonge Subway Extension, and the Scarborough Subway Extension projects as the sole responsibility of Metrolinx, per Section 46 of the Metrolinx Act, 2006. As identified in the Province's New Subway Transit Plan for the Greater Toronto and Hamilton Area (GTHA), the Relief Line project will be replaced by the new Ontario Line that is proposed to connect the Ontario Science Centre to Ontario Place. In addition, plans for the Scarborough Subway Extension will be amended to include three proposed stops at Lawrence East Station, Scarborough Town Centre Station and McCowan Station. Metrolinx will work closely with Infrastructure Ontario and municipal partners on the planning, design and delivery of these projects.

Analysis of Regulatory Impact:
The proposed regulation would have no new annual compliance or administration costs for businesses in Ontario.

If the proposed regulation were approved, there could be potential impacts to the City of Toronto, its agencies, and potentially some of its contractors as a result of transferring the projects to the Province. The Province would engage with the City of Toronto, partner municipalities, and their agencies, as well as relevant vendors, to understand potential implications and ensure that negative impacts are minimized.

Summary of Proposal:
If Bill 107, Getting Ontario Moving Act (Transportation Statute Law Amendment), 2019 is passed into law by the Ontario Legislature, the Metrolinx Act, 2006 would be amended to include the ability for the Province to prescribe a rapid transit project as the sole responsibility of Metrolinx. The project would become part of Metrolinx's regional transit system. In addition, the Province would have the authority to transfer assets, liabilities, rights and obligations related to the project from the City of Toronto to Metrolinx, through an Order in Council. Contingent on the above Bill being passed into law by the Ontario Legislature, the Ministry of Transportation is proposing a regulation that would make Toronto's proposed Relief Line, the Yonge Subway Extension, and the Scarborough Subway Extension projects the responsibility of Metrolinx. The Government is committed to building better regional public transit and transportation infrastructure, delivering faster service, and putting people first by making public transit an attractive, affordable and low-stress alternative for individuals and families. Part of this initiative includes a commitment, outlined in the 2019 Ontario Budget - Protecting What Matters Most, to upload the TTC subway infrastructure from the City of Toronto to the Province. The overall objective is to create an integrated regional transit system to meet the growing demand in the GTHA and help reduce traffic congestion.

As committed in the 2019 Ontario Budget - Protecting What Matters Most, this proposal would allow the Province to take over responsibility for and shape new subway projects so that they meet the growing needs of commuters in the region. This would help get transit projects built in the GTHA to keep commuters moving. It also ensures that the Province is able to critically examine the optimal delivery method and leverage private sector innovation to deliver these projects in a cost-effective manner. The Province views municipalities in the region and their agencies, including the City of Toronto and the TTC, as important partners - now and in the future - to build subways faster. The Province intends to build on existing planning and design work, and will continue to collaborate with partners in getting these projects built.

The initiative described above requires amendments to Ontario legislation. Implementing this initiative would be conditional on the passage/approval of the amendments identified above.
