Summary of Proposal:
The basic Training and Testing Regulation comes into force on April 15, 2010. This Regulation establishes a mandatory training and testing program that individuals must comply with before they are eligible to obtain a licence to act as a security guard or private investigator.

The mandatory basic training course must conform to the training curricula published by the Ministry of Community Safety and Correctional Services for security guards or private investigators. The mandatory tests are the licensing tests set by the ministry for security guards or private investigators.

Training programs may only be delivered by training entities specified by the regulation, subject to conditions.

The Regulation also provides a transitional rule for individuals who hold a valid security guard or private investigator licence as of April 15, 2010. Existing licensees will not be required to complete basic training before attempting the ministry test. Licence holders with licences that expire on or before July 15, 2010, may renew their licence once more without completing the mandatory test. Individuals with licences that expire on or after July 16, 2010 must pass the respective ministry licensing test before thy may apply for their licence renewal.

It is an offence for a licensed or registered business under the Private Security and Investigative Services Act, 2005, to provide training which does not conform to the ministry’s curricula, or for a person to provide training who is not a specified training entity.

The Regulation complies with the labour mobility provisions of the Agreement on External Trade by not imposing re-certification requirements on individuals who are licensed and certified as private investigators or security guards by another province or territory.
