Amendments to Ontario Regulation 297/13 (Occupational Health and Safety Awareness and Training)

Summary of Decision:
Effective March 27, 2020, the validity period of Working at Heights training for workers who successfully completed an approved program between February 28, 2017 and August 31, 2017 has been temporarily extended. The validity period has been extended to four years from the current three.

In Ontario, workers who are required to use certain fall protection equipment on construction projects must complete Working at Heights (WAH) training approved by the Chief Prevention Officer (CPO), which must be delivered by a CPO-approved training provider. The training is valid for three years. Requirements are set out in the Occupational Health and Safety Awareness and Training Regulation (O. Reg. 297/13), made under the Occupational Health and Safety Act.

Extending training validities that would otherwise have expired between February 28, 2020 and August 31, 2020 by one year ensures the affected workers are able to continue to work while allowing them extra time to renew their training validity.
Analysis of Regulatory Impact:
The amendment will not result in any additional costs to employers or workers, but rather extends the validity period of Working At Heights training by one year for certain workers.
