Summary of Decision:
On January 31, 2008, the Minister of Energy issued a ministerial directive for a Request for Proposals (RFP) to the Ontario Power Authority (OPA) to procure approximately 350 MW of new gas-fired peaking generation in Northern York Region. On December 11, 2008, Ontario Power Authority (OPA) awarded the contract to Pristine Power for a site (York Energy Centre) to be located at 18781 Dufferin Street and 18765 Dufferin Street.

The facility is needed to support the projected population growth in York Region. The lack of additional capacity and diversity in supply sources presents a significant risk to residents in northern York Region.

York Energy Centre has completed the environmental assessment requirements for this type of electricity project.
Section 62.0.1 of the Planning Act provides that an energy undertaking is exempt from the Planning Act where it is the subject of an approval, order, declaration or exemption under the Environmental Assessment Act (EA Act) and where the Lieutenant Governor in Council (LGIC) has prescribed the undertaking.

Section 70(h) of the Planning Act provides the statutory authority to make a regulation prescribing an undertaking or class of undertakings related to energy.
On July 29, 2010 the LGIC made a regulation prescribing the York Energy Centre project for the purposes of clause 62.0.1(1)(b) of the Planning Act.
