Regulating 13 invasive species and watercraft as a carrier of invasive species under the Ontario Invasive Species Act, 2015

Summary of Decision:
The Ministry has finalized regulatory amendments to Ontario Regulation 354/16 under the Invasive Species Act, 2015 to classify 13 species as either prohibited or restricted invasive species and regulate watercraft as a carrier of invasive species. A new regulation 703/21, Invasive Species Control Areas has also been created to prescribe the province as a control area for pigs (Sus Scrofa) to prevent the establishment of a wild pig population in Ontario.

The regulation of these species and carrier improve Ontario's ability to prevent the introduction and spread of these and other invasive species, thus avoiding future ecological, social and economic harm and management costs.

Analysis of Regulatory Impact

Invasive species are recognized as one of the key threats to Ontario's natural environment and native species. The ecological effects of invasive species are often irreversible and, once established, they are extremely difficult and costly to control and eradicate.

The regulation of these invasive species and watercraft as a carrier will enhance efforts and the tools available to prevent the introduction and spread of invasive species in Ontario and will reduce the likelihood that they will impact Ontario's environment in the future.

No significant impacts have been identified by stakeholders in response to the proposed regulations posted on the ERO or in response to direct outreach and discussions. Minor adjustments have been made, as appropriate, in response to input and recommendations received. These were largely to improve clarity or to enhance enforceability of the rules, while maintaining the intent and outcomes of the proposal.

There are no new operating costs associated with these changes. The average annual present value cost is $2,088 with the total present value cost of $20,900 for pig producers (over 10 years) to learn about new rules to address pig escapes, to notify the Minister of Northern Development, Mines, Natural Resources and Forestry
Analysis of Regulatory Impact:
We are seeking input on the anticipated costs and the proposed approach to allow producers, processors and sellers to fulfill commitments and transition their business from Eurasian Wild Boar as well as potential economic impacts resulting from the regulation of these species and watercraft as a carrier.
