Nutrient Management Act Further Burden Reduction Opportunities

Summary of Decision:
As part of Ontario's Open for Business Action Plan, the government is committed to cutting red tape and reducing regulatory burden for all businesses, organizations, and individual farmers, while continuing to maintain environmental protection. Reducing burden and lowering operating costs for farmers is a critical part of ensuring rural Ontario remains economically vibrant and competitive.

Regulatory amendments to O. Reg. 267/03 were made to remove the five-year expiry of the Agricultural Operation Planning (AOP) certificate, which still maintains environmental protections. This change will save farmers and farm businesses time and money as farmers will no longer have to re-take nutrient management training to re-certify every five years. Housekeeping amendments to the Regulation and Nutrient Management Protocol (Protocol) were also made to add clarity, simplify rules and enhance compliance.
Analysis of Regulatory Impact:
The Government amended O. Reg. 267/03 under the NMA to remove the five-year expiry of the Agricultural Operation Planning (AOP) certificate. Housekeeping amendments to the Regulation and Protocol were also made to add clarity, simplify rules and enhance compliance.

The amendments will reduce administrative burden, reduce costs, and save time normally spent in training. Proposed regulatory amendments will save the industry an estimated $18,440 annually and will save individual businesses $158.20 in direct costs every five years. Businesses will also benefit from the housekeeping amendments to the Regulation and Protocol which will increase clarity, simplify rules and enhance compliance.

The amendments are expected to make it easier to comply with environmental protection requirements without adding costs for farmers or reducing any environmental protections.
