These amendments update the outdated reference to the OSPCA Act, and designate the Provincial Animal Welfare Services Act and its regulations under sections 7, 10 and 14 of the RMA. These sections enable Ministers responsible for the designated statutes to collect, use and disclose (including publish) appropriate compliance-related information and to authorize persons to exercise powers under the designated statutes.

Summary of Proposal:
The Regulatory Modernization Act, 2007 (RMA), administered by the Ministry of Labour, Training and Skills Development, provides Ontario's regulatory ministries with tools that they can use to promote efficient and effective regulatory compliance.

The proposed amendments to Ontario Regulation 75/08: Designations under the RMA would:

• Update the reference to the Ontario Society for the Prevention of Cruelty to Animals Act (OSPCA Act) and its regulations which are now repealed and revoked, respectively. The OSPCA Act and its regulations would continue to be designated for the purposes of section 7 (information sharing) and section 10 (publication) of the RMA, but they would now be designated as a repealed Act and revoked regulations.

• Designate the Provincial Animal Welfare Services Act, 2019 (PAWS Act) and its regulations, which replaced the former OSPCA Act and its regulations, for the purposes of section 7 (information sharing), section 10 (publication) and section 14 (multiple authorizations).

These amendments would update the outdated reference to the OSPCA Act, and designate the PAWS Act and its regulations under sections 7, 10 and 14 of the RMA. These sections enable Ministers responsible for the designated statutes to collect, use and disclose (including publish) appropriate compliance-related information and to authorize persons to exercise powers under the designated statutes.
