Summary of Proposal:
Ministry of Consumer Services (MCS) is amending the MVDA to enhance consumer protection and strengthen confidence in the vehicle sales marketplace. The name of the Act has changed to Motor Vehicle Dealers Act, 2002 and will come into force on January 1, 2010.

The MVDA governs the business practices of Ontario’s motor vehicle dealers and salespeople. Ontario Motor Vehicle Industry Council administers the MVDA, 2002 on behalf of the Ministry of Consumer Services.

These amendments are required to reflect the new name of the Act. Also, “exemption certificates” are not part of the new Act and have been replaced with registration as an “outside Ontario dealer.” This terminology must also be updated in the HTA regulations.

No substantive change to the regulations is being proposed. The new Act comes into force on January 1, 2010.
