Summary of Proposal:
The Act would require the Minister to maintain a supply of PPE and CSE.
The Act would authorize the Minister to provide or support supply chain management in respect of personal protective equipment and critical supplies and equipment on behalf of government entities and public sector entities. The Act would also authorize the Minister to provide such supply chain management for other entities and individuals, if certain conditions are met.
The Act would prohibit a person from selling or offering to sell any personal protective equipment or critical supplies and equipment that the person obtained as a result of supply chain management provided by the Minister and without charge or payment of a fee. A person who contravenes the prohibition would be liable to a fine.
Consequential amendments would be made to the Supply Chain Management Act (Government, Broader Public Sector and Health Sector Entities), 2019, to clarify that it would not include activities related to the procurement of PPE and CSE.
Analysis of Regulatory Impact:
The Personal Protective Equipment Supply and Production Act, 2022will be enabling legislation that itself will not impose new compliance costs on entities covered by the Act. However, accompanying regulations to be developed (or a notice made under the Act) may impose new obligations and an assessment of new compliance costs will be undertaken at that time.
