Summary of Decision:
With the support of Grain Farmers of Ontario, the Ontario Farm Products Marketing Commission amended Regulation 485/09: Grains - Marketing under the Farm Products Marketing Act to:

•revoke a provision that requires the members of the Grain Industry Advisory Committee (GIAC) to meet at least once per year; and
•clarify the term of negotiated soybean agreements.

The amendments came into effect upon filing.
Analysis of Regulatory Impact:
Removing the mandatory meeting provision, will align Grain Industry Advisory Committee (GIAC) meeting requirements with the majority of other IACs that are established in regulation. The GIAC will continue to exist and GIAC members are free to plan and schedule a meeting(s) when they feel one is required.

The proposed updated wording changes concerning the soybean agreement's term will align the regulation more closely with the actual practice of the sector.

There are no direct compliance cost increases or savings associated with the amendments.

Summary of Proposal:
Section 18 in O. Reg. 485/09 establishes the Grain Industry Advisory Committee (GIAC), and specifies:

• Membership and term of appointment;
• Appointment and re-appointment processes;
• GIAC mandate; and
• Requirement to meet

Subsection 18(8) states that the GIAC shall meet at least once each year. The requirement to meet was included at the time Grain Farmers of Ontario (GFO) was being established in 2009, through the merger of three organizations that previously represented corn, soybean, and wheat producers.

The inclusion of the meeting requirement was to ensure that stakeholders involved in the Ontario grain sector had an established neutral forum to meet and discuss industry issues.

Over the last ten years, GFO, the Ontario Agri Business Association, millers, oilseed processors and the seed trade have developed direct communication channels and have addressed issues in a collaborative fashion.

The Commission still encourages use of GIAC when appropriate but feels industry knows when these meetings should be taking place rather than having the frequency of meetings being a requirement within the regulation, giving them the flexibility to meet when needed.

Subsection 19(3) specifies that the term of negotiated soybean agreements be stated in the agreement. The Commission is proposing minor wording changes to clarify that the regulations are consistent with the negotiating agency's use of a provision to automatically extend the agreement.
