Summary of Decision:

Analysis of Regulatory Impact:
There are no direct compliance costs or new administrative burdens associated with the exemption regulation. The regulation is administrative in nature. All environmental assessment work under the Municipal Class Environmental Assessment (the Class EA) for the road improvements project is complete and consultation will be completed by the effective date of the regulation. Based on the ministry's review of the Class EA documentation, the ministry does not have outstanding concerns with the project or class EA process carried out.

Summary of Proposal:
Bombardier Inc. requested an exemption from subsection 15.1.1(5) of the Environmental Assessment Act for certain road improvements in the City of Mississauga that are associated with the company's new manufacturing facility. Subsection 15.1.1(5) prohibits a person from proceeding with an undertaking for 30 days after the end of the final public comment period of a class environmental assessment process.

Bombardier, in partnership with the City of Mississauga and the Region of Peel, has completed a Municipal Class Environmental Assessment (Class EA) process for road improvements near Derry Road East and Alstep Drive in the City of Mississauga (the project). The project is associated with the new Bombardier Aerospace Pearson facility (under construction) and is needed to provide for the timely entrance and exit of 2,000 employees to the facility, as well as to provide traffic capacity for other development in the area. The project is expected to ease traffic flow for the local community and existing and future businesses in the area.

Due to subsection 15.1.1(5) of the Environmental Assessment Act, project construction cannot commence until September 28, 2022, at the earliest.

The exemption regulation allows the proponent to proceed to construction faster, helping the company transition on schedule to its new manufacturing facility. The exemption does not apply with respect to any changes to the project.
