Summary of Proposal:
The proposed amendment will add approximately 660 hectares to the Niagara Escarpment Planning Area in Hamilton, Burlington and Milton. These areas are commonly referred to in this note as the Dufferin lands, the Royal Botanical Garden (RBG) lands, the Gap lands and Pleasant View Survey.

These four areas are not presently part of the Niagara Escarpment Planning Area as prescribed by Regulation 827 of the Niagara Escarpment Planning and Development Act. The addition of the lands to the Niagara Escarpment Planning Area is a legal prerequisite to the subsequent initiation of Niagara Escarpment Plan amendments that could potentially add some or all of these lands to the Niagara Escarpment Plan Area.

The Plan amendment process is a separate and subsequent process under the Niagara Escarpment Planning and Development Act. The final decision on the Niagara Escarpment Plan amendments by the Minister or Cabinet will determine if all or parts of these areas should be added to the Niagara Escarpment Plan Area and which land use designations will be placed on the lands added to the Niagara Escarpment Plan Area. The degree of environmental and land use control impacts will be assessed during the Niagara Escarpment Plan amendment process.

The amendment process is prescribed in the Niagara Escarpment Planning and Development Act and is entirely separate from this proposal’s outcome. The Niagara Escarpment Plan amendments will be placed on the Environmental Registry as four separate proposal notices once those processes are initiated under the Niagara Escarpment Planning and Development Act.

There are no environmental or land use control impacts to adding the lands to the Niagara Escarpment Planning Area as the existing land use controls (i.e., municipal, Greenbelt Plan and/or Parkway Belt West Plan) will remain in place.
