Summary of Proposal:
Clause 19(1)(b) of the Places to Grow Act, 2005 enables the Minister to make regulations that prescribe the manner in which a notice is given for clauses 10(3)(a) and 11(1)(b) and the persons, public bodies and other bodies to whom notice shall be given under subsection 10(3) and clause 11(1)(b).

This proposed Minister’s regulation would set out that notice of a proposed amendment to a growth plan would be given to all persons, public bodies and other bodies that, in the opinion of the Minister, are affected by the proposed amendment. This notice would be given by mail, e-mail, fax or personal service; if notice is required to be given to a municipality, it would be given to the clerk of the municipality; and the Minister would be required to ensure that notice of the proposed amendment is given on the environmental registry established under section 5 of the Environmental Bill of Rights, 1993.

This proposed Minister’s regulation would also set out that notice of a hearing be given to all persons, public bodies and other bodies that, in the opinion of the Minister, are affected by the subject matter of the hearing. This notice would be given by mail, e-mail, fax or personal service; if notice is required to be given to a municipality, it would be given to the clerk of the municipality; and the hearing officer would be required to ensure that notice is posted in a public place in the municipality or published in a newspaper that, in the opinion of the hearing officer, is of sufficiently general circulation in the municipality that it would give the public reasonable notice of the hearing.
