Summary of Proposal:
Bill 133, the Family Statute Law Amendment Act, 2009, received Royal Assent in May 2009. Among other family law initiatives, Bill 133 introduces new rules on how to value and settle pension assets on the breakdown of a marriage. The provisions of Bill 133 that amend the Pension Benefits Act require the enactment of corresponding regulations prior to proclamation. This posting provides a summary of these proposed regulations.

The posting is divided into two parts. The first part consists of a draft regulation, which contains the majority of the content required to implement the new pension division regime. The second part consists of a brief paper which outlines the contents of the regulation that are currently under consideration.

The government is interested in public feedback on this important initiative and welcomes comments on both parts of this posting.
