Requirements for Submitting a Complete Environmental Compliance Approval Application

Summary of Decision:
On April 13, 2011, the Ministry posted a proposal to develop a new regulation under the Environmental Protection Act that would prescribe minimum application requirements for environmental compliance approvals. The focus was on generic requirements that would be applied to all project types.

A decision has been made to prescribe these requirements for the purposes of the 20.2(4) and 20.14(2) of the Act. The regulation was filed with the Registrar of Regulations as Ontario Regulation 255/11 (O.Reg. 255/11) on June 14, 2011. The regulation will be supported by a smart application form and accompanying guidance documents.

These requirements will only apply to applicants who are applying for an environmental compliance approval and do not apply to renewable energy approvals, permits to take water, drinking water systems and municipal licensing, or licensing and certification programs such as pesticides and well drillers.

These requirements will affect applications for the new Environmental Compliance Approval, which replaces the Certificate of Approval program, starting September 19, 2011.

The attached document contains draft requirements that are proposed to be the basis of a regulation for a complete application. This regulation will focus on generic requirements that will be applied to all project types. A future proposal will be posted on the environmental registry and will describe any specific technical requirements for each project type (e.g. technical requirements for waste disposal sites, waste management systems, sewage works or activities that may discharge contaminants to the air).
