Proposed Environmental Activity and Sector Registry Group 1 Activities and Sectors Regulations

Summary of Decision:
On April 13, 2011 the Ministry posted a proposal for a regulation under the Environmental Protection Act that would prescribe the following activities for the purposes of 20.21 of the Act (the Environmental Activity and Sector Registry):

- automotive refinishing (autobody shop spray booths)
- heating systems
- standby power systems

A decision has been made to prescribe these activities for the purposes of the 20.21 of the Act. The regulation was filed with the Registrar of Regulations as Ontario Regulation 245/11 (O.Reg. 245/11) on June 14, 2011.

The regulation defines the specific requirements that would make an activity eligible to be registered on the Environmental Activity and Sector Registry. In addition, it defines for those activities that are eligible to register specific operating and/or documentation and record keeping requirements. The requirements do not change current standards.

As part of the Ministry's Modernization of Approvals initiative, the Environmental Activity and Sector Registry provides a more effective and efficient environmental approvals process while maintaining environmental protection. Businesses will be able to register these activities starting September 19, 2011.

Summary of Proposal:
In order for activities to be registered on the EASR, the Environmental Protection Act
requires that they be prescribed by regulation.

Proposed Regulation

The Ministry has decided, at this time, to proceed with consultation on a proposed
regulation under the Environmental Protection Act to allow the following sectors and
activities to register on the EASR:
● Automotive Body, Paint and Interior Repair and Maintenance Sector,
● Provision of Comfort Heating in Buildings, and
● Standby Power Generation Equipment in Buildings
