Summary of Decision:
O. Reg. 399/11:
O. Reg. 399/11 delegates the authority of the Minister of Municipal Affairs and Housing under section 51 of the Planning Act to approve a plan of subdivision/condominium to the council of the Township of Sioux Narrows-Nestor Falls with respect to all applications for land in that municipality made on or after this Regulation comes into force.
O. Reg. 400/11:
The Schedule to O. Reg. 525/97 under the Planning Act is amended by adding the Township of Sioux Narrows-Nestor Falls to the list of municipalities that are exempt from Ministerial approval of Official Plan Amendments.
O. Reg. 399/11 and O. Reg. 400/11 came in force on August 25, 2011.
O. Summary of Proposal:
The Township of Sioux Narrows-Nestor Falls is seeking the Minister of Municipal Affairs and Housing's delegation of Ministerial approval for Plans of Subdivision and Condominiums as well as exemption from Ministerial approval of Official Plan Amendments in accordance with Subsections 4(1) and 17(9) of the Planning Act.
In February 2011, the Ministry of Municipal Affairs and Housing received a Council resolution requesting delegation of Ministerial approval for plans of subdivision and condominium, and exemption from Ministerial approval for official plan amendments.
In the Kenora District, four municipalities have delegated subdivision/ condominium approval. In the Northwest, the Cities of Thunder Bay, Kenora and Dryden have delegated approval authority for both Subdivision/Condominium applications and have exemption for Official Plan Amendments.
The Township has a recently approved Official Plan that is consistent with the 2005 Provincial Policy Statement. The Official Plan is structured as a detailed planning document which provides planning direction on the full range of provincial and local land use planning interests.
The Township of Sioux Narrows-Nestor Falls (the Township) is located in southwest Kenora District along the eastern shores of Lake of the Woods.
Section 4(1) of the Planning Act states that the Minister may, on the request of the council of a municipality, delegate to the council any of the Minister?s authority (other than the Minister's authority to exempt) under the Act.
Section 17(9) of the Planning Act states that the Minister may, by order, exempt a plan or proposed official plan amendment from the Minister?s approval and that the order may be in respect of any or all plans or proposed official plan amendments.
