Summary of Decision:
On May 17, 2011, the Ontario government took action to protect residents by bringing forward the immediate protection measures as implemented in part by O. Reg. 165/11. These measures assist retirement home residents who have been abused or are at risk of being abused to access help now, before the Act comes into full force, by:

- Making it mandatory to report any suspected harm or risk of harm to a resident to the RHRA?s Registrar.
- Obligating the Registrar to order an immediate inspection of a home, following any reports of abuse or neglect.
- Requiring all retirement home operators to post a sign with the Complaints Response and Information Service (CRIS) help number in a highly visible and easily accessible location.

The Minister Responsible for Seniors decided that, in accordance with clause 122 (6) (a) of the Act, the urgency of the situation required the provisions in O. Reg. 165/11 to be put in place immediately. As a result, the Minister decided that the default public consultation requirements under the Act did not apply to the provisions in O. Reg. 165/11 on which the OSS had not previously consulted. The regulation was filed on May 16, 2011.
