Summary of Decision:
This regulatory amendment replaces Stewardship Ontario's current method of how fees are calculated under the MHSW program. The amount that stewards pay will be based on the costs of operating the program each quarter, and charged to stewards based on their reported market share. The changes also specify how Stewardship Ontario should address accumulated deficits.

Under the Waste Diversion Act, 2002 stewards pay fees to Industry Funding Organizations (such as Stewardship Ontario) who develop, implement and operate waste diversion programs for designated wastes. Ontario's waste diversion programs play an important role in keeping wastes out of our land and waterways.

These industry funded programs need industry-funded solutions to recover the necessary costs to meet their targets for waste diversion.

The Municipal Hazardous or Special waste program has been collecting and safely recycling or disposing household hazardous wastes since July 1, 2008.

The Ministry has developed a regulatory amendment that will change how stewards pay for the cost of managing their products (e.g. paint and single-use batteries) under the Municipal Hazardous or Special Waste program. The amount that stewards pay will be based on the costs of operating the program each quarter, and charged to stewards based on their reported market share. The changes also specify how Stewardship Ontario should address accumulated deficits.

This regulatory amendment replaces Stewardship Ontario's current method of how fees are calculated under the MHSW program.
