Summary of Decision:
In July 2022, the Ministry of Education (EDU) filed a new regulation under the Education Act titled O Reg 466/22: Lodging in Provincial and Demonstration Schools for English and French Provincial and Demonstration School lodgings. The regulation came into effect as of January 1, 2023. While operational policies currently exist setting requirements for the operation of student lodgings, O. reg 466/22 will enhance student safety, support a healthy and supportive environment, and promote consistency across student lodgings directly operated by EDU and the Consortium Centre Jules-Leger (CCJL) respectively. The regulation also enshrines many of the existing elements currently set out in policy and also adopt practices from children and youth residences and child-care settings under the Child, Youth and Family Services Act, 2017 (CYFSA) and the Child Care and Early Years Act, 2014 (CCEYA).

EDU directly operates seven English Provincial and Demonstration schools across four sites (Milton, Belleville, London, and Brantford). The schools offer the Ontario curriculum at the elementary and secondary levels as well as specialized integrated programming and student residences. The fifth Provincial and Demonstration school site is the CCJL, which provides the French-language equivalent curriculum. The CCJL is governed by trustees appointed from among the elected trustees of the French-language school boards and is located in Ottawa.
Analysis of Regulatory Impact:
The majority of lodgings are directly operated by the ministry. There is only one site which is operated by the CCJL. The implementation of the regulation will result in a modernized set of lodging standards that would enhance student safety, support a healthy and supportive lodging environment, and promote consistency across publicly funded school lodgings. As a result of the implementation of new lodging standards, lodgings would need to undertake some direct compliance activities such as learning about the new lodging regulation, maintaining records, updating policies and procedures, and undergo inspections which would take place at least once per school year.

The regulation, if approved and made, would enshrine many of the existing elements currently set out in policy and also adopt practices from children and youth residences and child-care settings under the Child, Youth and Family Services Act, 2017 (CYFSA) and the Child Care and Early Years Act, 2014 (CCEYA).
