College Introduction

In Ontario, the regulation of health professions is based on a self-governance model. There are 23 health regulatory colleges governing 25 health professions under the Regulated Health Professions Act, 1991 (RHPA) and their respective health profession Acts.

Under the RHPA and the Respiratory Therapy Act, 1991, the College of Respiratory Therapists of Ontario (CRTO) is responsible for governing the self-regulating profession of respiratory therapy in Ontario. Under these Acts, the CRTO may make regulations on a variety of subject matters, including conflict of interest, subject to the prior review by the Minister of Health and Long-Term Care and the approval of the Lieutenant Governor in Council.

Summary of Proposal

The CRTO is amending its general regulation (O.Reg. 596/94) made under the Respiratory Therapy Act, 1991 to introduce new conflict of interest provisions.

The amendments would:

a) define what constitutes a conflict of interest for members of the profession, both in general and with respect to specific practice situations; and
b) prohibit members from practising the profession while in a conflict of interest
