Summary of Proposal:
School bus drivers must currently obtain a clear criminal record check report to qualify for and hold a Class B or E (school bus) driver's licence (Regulation 340/94 under the Highway Traffic Act).
The Ministry of Education (EDU) has a regulation (O. Reg. 521/01) that requires criminal record checks of board employees and service providers. School bus drivers are exempted service providers in this regulation because the requirement is set out in the Highway Traffic Act regulation.
Effective July 2013, the criminal record check requirement for school bus drivers will be removed from the school bus driver's licence requirements under the Highway Traffic Act regulation and placed in the Ministry of Education regulation. School bus drivers will no longer be exempted service providers under this EDU regulation. This Regulation comes into force on the later of September 1, 2013.
