Summary of Decision:
O. Reg. 353/02 (Approval Authority - Plans of Subdivision) made under the Planning Act, was amended by O. Reg. 102/13 (Approval Authority- Plans of Subdivision) made under the Planning Act. This amendment makes certain municipalities approval authorities under sections 51 and 51.1 of the Act. This has the effect of giving the councils of these municipalities the power to approve subdivision and condominium applications within their geography.

As a result of the making of O. Reg. 102/13 (Approval Authority - Plans of Subdivision), and also O. Reg. 103/13 (Consent Granting Authority), the following consequential amendment was made:
-O. Reg. 106/13 (Revoking Various Regulations) revoked O. Reg. 190/01 (Delegation of Authority - Town of Sioux Lookout), O. Reg. 337/98 (Delegation of Authority - Plans of Subdivision and condominiums, Town of Sioux Lookout, and, O. Reg. 335/98 Delegation of Authority to Give Consents - Town of Sioux Lookout)

O. Reg. 102/13 (Approval Authority - Plans of Subdivision) made under the Planning Act comes into force on January 1, 2014.

Description of Regulation:
The Minister of Municipal Affairs and Housing is proposing to amend Ontario Regulation 353/02 (Approval Authority - Plans of Subdivision) under the Planning Act in order to make certain municipalities approval authorities under sections 51 and 51.1 of the Act. This would have the effect of giving the councils of these municipalities the power to approve subdivision and condominium applications within their geography.

The proposed amendment would provide this authority to 21 municipalities which have up-to-date official plans, namely:
1. Township of Pelee
2. Township of Alberton
3. Township of Armstrong
4. Township of Baldwin
5. Township of Brethour
6. Municipality of Callander
7. Township of Dubreuilville
8. Township of Gauthier
9. Township of Hilliard
10. Municipality of Huron Shores
11. Township of Ignace
12. Township of Larder Lake
13. Township of McGarry
14. Town of Moosonee
15. Township of Morley
16. Township of Prince
17. Township of Red Rock
18. Town of Thessalon
19. Village of Thornloe
20. Township of Val Rita-Harty
21. Municipality of Wawa

It is proposed that the identified municipalities would receive their new authority on January 1, 2014.

Purpose of Regulation:
The Province is committed to a sound, efficient and effective planning system that enhances local autonomy and streamlines decision-making on planning applications. This proposed regulation would empower councils as the planning approval authorities for subdivision/condominium applications within their municipalities.

Other Information:
This initiative reinforces MMAH's commitment to ensuring decision-making at the local level where municipalities have up-to-date official plans consistent with the Provincial Policy Statement (PPS) 2005.
