O.Reg. 352/02 (Mandatory Adoption of Official Plans) made under the Planning Act, was amended by O. Reg. 101/13 (Mandatory Adoption of Official Plans) made under the Planning Act. This amendment requires all upper-tier municipalities to adopt an official plan. The amending regulation only impacts those upper-tier municipalities that have not had an official plan in place or had not adopted an official plan. It requires any such municipalities to adopt an official plan no later than March 31, 2015.

Description of Regulation:
This is a proposal by the Minister of Municipal Affairs and Housing to amend Ontario Regulation 352/02 (Mandatory Adoption of Official Plans) under the Planning Act to require all upper-tier municipalities to adopt an official plan.
The proposed amending regulation would only impact those upper-tier municipalities that had not had an official plan in place or had not adopted an official plan. It would require any such municipalities to adopt an official plan no later than March 31, 2015.

Purpose of Regulation:
Ontario's planning system and the Provincial Policy Statement (PPS) 2005 are aimed at building and maintaining strong communities, a clean and healthy environment and a strong economy. As well, an efficient and effective planning system is based on having up-to-date official plans that guide accountable municipal governments in making day-to-day local land use planning decisions.

Other Information:
Upper-tier official plans have played a significant role in shaping local communities while protecting provincial interests. As we move forward, upper-tier plans will continue to play critical roles in co-ordinating infrastructure investments, and creating a climate for economic development while allowing for effective local decision-making.
