Summary of Proposal:
The Ministry of Community Safety and Correctional Services (MCSCS) is proceeding to draft a regulation under the Fire Protection and Prevention Act, 1997.

The proposed regulation will require municipal / community fire chiefs to ensure the inspection of all buildings upon receipt of a fire safety complaint or request for approval by the Chief Fire Official to meet the fire safety requirements of the Fire Code. In municipalities without a fire department, the community fire safety officer or the head of the community fire safety team is required to ensure an inspection is conducted. In unorganized communities without a fire department, the Fire Marshal is required to ensure an inspection is conducted.

The proposed regulation would formalize current Office of the Fire Marshal and Emergency Management (OFMEM) policy, and fire department practice as articulated in Public Fire Safety Guideline PFSG 04-40D-03Inspections upon Request or Complaint, which can be viewed on the OFMEM's website at: http://www.mcscs.jus.gov.on.ca/english/FireMarshal/FireServiceResources/PublicFireSafetyGuidelines/OFM_Guidelines.html

A supporting Fire Marshal Directive will be issued by OFMEM to clarify the obligations and operational requirements of each fire department under the proposed regulation.

Once filed, the proposed regulation will come into force on January 1, 2014.
