Summary of Decision:
O. Reg. 360/13 amends O. Reg. 332/12 (Building Code) under the Building Code Act, 1992.

O. Reg. 360/13 changes fees for building practitioner qualification and registration and establishes new fees for other Building Code services to enhance the effectiveness and sustainability of these programs.

The Ministry of Municipal Affairs and Housing (MMAH) proposed amendments to Ontario Regulation 332/12 (Building Code) under the Building Code Act, 1992.

MMAH proposed the following amendments to the Building Code regulation:

1. Change the fee for Building Code examinations administered or authorized by MMAH to $150.

2. Change registration fees and establish new registration requirements for specified practitioners (See Appendix).

3. Establish authority to require use of a standard form when submitting evidence of insurance for designers engaged in the business of providing design activities to the public and registered code agencies.

4. Create a fee of $170 for Building Code Commission (BCC) applications.

5. Create a fee of $560 for requests for Minister's Rulings authorizing the use of innovative materials, systems or building designs.

6. Registration fees, as well as BCC and Minister's Rulings fees, would be subject to Consumer Price Index adjustments on a go-forward basis.

These changes were made through Ontario Regulation 360/13:

7. Examination fees, as well as fees for the BCC and Minister?s Rulings, and the authority to require use of a standard form when submitting evidence of insurance, came into force January 1, 2014.

8. Registration fees and registration requirements came into force January 1, 2015.

Summary of Proposal:
The Ministry of Municipal Affairs and Housing (MMAH) is proposing amendments to Ontario Regulation 332/12 (Building Code) under the Building Code Act, 1992. The purpose of the proposed amendments would be to enhance the effectiveness and sustainability of the building practitioner qualification and registration program and other programs under the Act.
