Summary of Decision:
Section 5 of Ontario Regulation 361/07 under the PSISA has been amended to:
- Cross-reference the correct regulation number for Ontario Regulation 37/08 (Eligibility to Hold a Licence - Clean Criminal Record); and
- Simplify the previous wording and remove reference to "any other act of Canada".

Summary of Proposal:
Ontario Regulation 361/07 (Information to be Provided to the Registrar) under the Private Security and Investigative Services Act, 2005 (PSISA) prescribes the documents, records or information that licensees must provide to the Registrar and the time and manner in which they must be provided.
Section 5 of the regulation requires individual licensees to notify the Registrar if they have been convicted or found guilty of an offence prescribed under Ontario's Eligibility to Hold a Licence - Clean Criminal Record Regulation (Ontario Regulation 37/08).
Section 5 of Ontario Regulation 361/07 has been amended to:
- Cross-reference the correct regulation number for Ontario Regulation 37/08 (Eligibility to Hold a Licence - Clean Criminal Record); and
- Simplify the previous wording and remove reference to "any other act of Canada".
The above amendments were necessary to ensure clarity and accuracy for the following reasons:
- The original regulation referenced regulation 360/07 instead of 37/08.
- It also made reference to words "any other act of Canada" whereas the Ontario Regulation 37/08 only references two other acts: the Criminal Code of Canada and the Controlled Drugs And Substances Act.
