Proposed Amendment to Regulation 628 of the Highway Traffic Act to Exempt Motor Vehicle Manufacturers from Licence Plate and Permit Requirements

Summary of Decision:
The regulation amendment will exempt motor vehicle manufacturers from licence plate and permit requirements under Regulation 628 of the Highway Traffic Act (HTA), if all of the following criteria are met:

o Vehicles are newly manufactured and still owned by the motor vehicle
manufacturer;
o Vehicles are being driven by a licensed driver;
o Vehicles are being driven from the place of manufacture to the shipping yard
with a distance no greater than eight kilometres;
o Vehicles must be adequately insured.

Dealer plates will still be required for any purposes that fall outside of the above-mentioned criteria.

The regulation will come into force on July 1, 2015.

The proposal:
o Demonstrates equal and fair treatment for manufacturers in Ontario by outlining generic requirements applicable to all.
o Stimulates efficiency and economic growth by introducing practical requirements for the automotive industry that allow for cost savings and maintenance of current productivity levels.
o Save impacted manufacturing plants from incurring new financial burdens (e.g. the purchase of dealer plates, additional resources to manage them, etc.) and ensures job security for automotive workers is not adversely affected.
o Addresses public concerns as manufacturers will be legally exempt from vehicle registration requirements through regulation, which is both accessible and transparent to the public.

The proposed regulation would come into force on July 1, 2014.
