Summary of Decision:
Ontario Regulation 458/11 (Reviews under Part IX of the Act) was amended to qualify the time constraints affecting the Ontario College of Trades' Board of Governors (Board) when establishing a trade classification review.

To change a trade's status from voluntary to compulsory or vice versa, a Trade Board must make a request to the Board of Governors to initiate a review by a review panel. The request is made by the Divisional Board for the sector to which the trade belongs in cases where there is no Trade Board for the trade.

Prior to the amendment, the College's Board was required to establish a trade classification review panel within 60 days upon receiving a request for a trade classification review.

The amendment allows the Board to establish a review panel within 60 days after receiving the request "or as soon thereafter as is practicable."

The purpose of this amendment is to allow the College time to carry out a review of certain aspects of its regulatory framework, including the process and criteria for reviewing the classification of trades.
